Article 1 — Seller

These terms of sale (the “Terms”) apply to sales concluded on the Harlone website between:

  • Harlone Watch, a SAS (French simplified joint-stock company) with a share capital of 1 000 €, whose registered office is at 47 rue Vivienne, 75002 Paris, France, registered with the RCS Paris 107 293 821, SIRET 107 293 821 00016, EU VAT number FR70107293821 (hereinafter “Harlone” or “we”);
  • and any natural person acting for purposes outside their trade or profession (hereinafter “the customer”).

Contact: contact@harlone-watch.com — telephone: +33 7 81 60 09 42.

The customer declares that they have read and accepted these Terms, by ticking the box provided for this purpose, before placing an order. The applicable Terms are those in force on the date of the order.

Article 2 — Product

Harlone offers for sale a watch in a limited edition of 50 pieces. Each piece is engraved with a unique number, from 01 to 50. The main characteristics of the watch are set out on the home page and the pre-order page of the website.

The visuals shown on the website may be renders or photographs of prototypes; they are labelled as such. The watch delivered matches the prototype shown, with one exception: the word “SAMPLE” engraved on the caseback of the prototype is replaced by the number of the piece.

Article 3 — Pre-order

The watch is sold on pre-order: it is paid for when ordering and delivered later, within the estimated delivery window shown before payment, namely 20 December 2026 – 20 January 2027.

The key stages of production are shared on Harlone’s Instagram account (@harlone_watch). Any information personally concerning the customer’s order, in particular a delay, is sent to them by email, at the address given when ordering.

Article 4 — Order

To order, the customer:

  1. chooses on the pre-order page one number among those available;
  2. accepts these Terms by ticking the box provided for this purpose;
  3. clicks the “Order and pay” button;
  4. is redirected to the secure payment page of our provider, where they enter their contact details, delivery address and payment information;
  5. confirms the payment.

An order covers a single watch, delivered to a single address in a parcel insured for its value. A customer wishing to buy several watches places one order per watch.

The chosen number is reserved for the customer for 15 minutes from the click on the order button. If payment is not confirmed within this time, the reservation is cancelled and the number becomes available again. The engraved number is a characteristic of the piece chosen from the series; it does not constitute a personalisation of the product.

The contract is concluded when the payment is confirmed. The customer then receives a payment receipt by email, followed, within 24 hours, by an order confirmation email summarising their order, together with these terms of sale and the withdrawal form.

Harlone reserves the right to cancel any order from a customer with whom there is a dispute regarding payment for a previous order, or in the event of proven fraud; the customer is then refunded in full.

Article 5 — Price

The price is €599 per watch, including VAT. Delivery costs are added to the price whatever the delivery country, France included; their amount depends on the country and is shown on the pre-order page as soon as the country is chosen, then repeated before payment.

The applicable price is the one displayed at the time of ordering.

Article 6 — Payment

The price is payable in full when ordering, by card. Payment is processed by our provider Stripe; it may be subject to strong authentication (3D Secure) by the customer’s bank. Harlone never has access to the customer’s card details.

The amount is charged when the order is confirmed.

Article 7 — Delivery

Delivery is made to the countries offered on the pre-order page, to the address given by the customer during payment, which must be located in the chosen country, by Colissimo (La Poste). The watch is shipped in a tracked parcel, delivered against signature; the tracking number is sent to the customer by email at the time of dispatch. The parcel is insured by Harlone, at its own expense, for its value.

Change of address. As long as the order has not been shipped, the customer may ask to change the delivery address by email to contact@harlone-watch.com. If the new address falls within a different delivery zone from the country chosen when ordering, the difference in delivery costs is requested before shipping, or refunded if the new zone is cheaper; failing payment, the order is delivered to the original address. French overseas departments and territories form a delivery zone separate from mainland France.

Import duties and taxes. For delivery outside the VAT territory of the European Union (in particular Andorra, Switzerland, the United Kingdom, French overseas territories and countries outside Europe), customs duties, taxes and clearance fees may be charged by the authorities of the destination country. They are not included in the price and remain payable by the customer, who is informed of this before payment. Refusal to pay these amounts on delivery does not entitle the customer to a refund of the delivery and return costs incurred.

Delivery date. Harlone undertakes to deliver the order within the estimated delivery window: 20 December 2026 – 20 January 2027.

Delay. If the order is not delivered within this window, the customer may, in accordance with Articles L. 216-6 et seq. of the French Consumer Code, require Harlone to make the delivery within a reasonable additional period and, failing that, terminate the contract in writing (email or letter). They are then refunded all sums paid within 14 days of termination at the latest.

Refund commitment. In addition, and without prejudice to the rights above:

  • if the order has not been delivered by 1 February 2027, the customer may, from that date, cancel their order by simple written request (email or letter), without prior formal notice or proof of loss;
  • if production of the watch does not go ahead, Harlone informs each customer by email and cancels the orders concerned.

In both cases, the customer is refunded in full, using the payment method used for the order, within 14 days of their request or of Harlone’s notification at the latest.

Receipt. The customer is invited to check the condition of the parcel on delivery and to report any anomaly (damaged parcel, missing product) to the carrier and to Harlone as soon as possible.

The risk of loss or damage passes to the customer when they, or a third party designated by them, take physical possession of the watch.

Article 8 — Right of withdrawal

In accordance with Articles L. 221-18 et seq. of the French Consumer Code, the customer has 14 days to withdraw, without giving any reason and without incurring any costs other than those provided for below.

The customer may exercise this right as soon as the contract is concluded, including before dispatch, and up to 14 days after receiving the watch.

How to withdraw. The customer informs Harlone of their decision by an unambiguous statement, by email to contact@harlone-watch.com or by post to the registered office, using the form in the appendix if they wish.

Return. The customer returns the watch, in its original condition and with its accessories, within 14 days of communicating their decision at the latest. Return costs are borne by the customer, including for returns from abroad; a tracked and insured shipment is recommended. The customer may be held liable for any diminished value of the watch resulting from handling other than what is necessary to establish its nature, characteristics and functioning.

Refund. Harlone refunds all sums paid, including the initial delivery costs, within 14 days of being informed of the customer’s decision at the latest, using the same payment method as for the order. If the watch has already been dispatched, the refund may be withheld until it has been received back or until the customer has supplied proof of having sent it back.

A returned watch may be put back on sale with its number.

Article 9 — Legal guarantees

The watch is covered by the legal guarantee of conformity (Articles L. 217-1 et seq. of the French Consumer Code) and by the guarantee against hidden defects (Articles 1641 to 1649 of the French Civil Code).

The consumer has two years from delivery of the goods to obtain the application of the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer only has to prove the existence of the lack of conformity, not the date on which it appeared.

Where the contract of sale provides for the continuous supply of digital content or a digital service for more than two years, the legal guarantee applies to that digital content or digital service throughout the planned supply period. During this period, the consumer only has to prove the existence of the lack of conformity affecting the digital content or digital service, not the date on which it appeared.

The legal guarantee of conformity requires the professional, where applicable, to provide all updates necessary to keep the goods in conformity.

The legal guarantee of conformity entitles the consumer to the repair or replacement of the goods within thirty days of their request, free of charge and without major inconvenience to them.

If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.

If the consumer requests repair of the goods but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement of the goods.

The consumer may obtain a reduction of the purchase price while keeping the goods, or terminate the contract and be fully refunded against return of the goods, if:

1° The professional refuses to repair or replace the goods;

2° The repair or replacement of the goods takes place after a period of thirty days;

3° The repair or replacement of the goods causes major inconvenience to the consumer, in particular where the consumer definitively bears the costs of taking back or removing the non-conforming goods, or bears the costs of installing the repaired or replacement goods;

4° The lack of conformity of the goods persists despite the seller’s unsuccessful attempt to bring them into conformity.

The consumer is also entitled to a price reduction or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination. The consumer is then not required to request repair or replacement of the goods first.

The consumer is not entitled to terminate the sale if the lack of conformity is minor.

Any period during which the goods are out of use for repair or replacement suspends the remaining guarantee period until the restored goods are delivered.

The rights mentioned above result from the application of Articles L. 217-1 to L. 217-32 of the French Consumer Code.

A seller who obstructs in bad faith the application of the legal guarantee of conformity is liable to a civil fine of up to €300,000, which may be increased to 10% of average annual turnover (Article L. 241-5 of the French Consumer Code).

The consumer also benefits from the legal guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund against return of the goods.

To make a claim under a guarantee, the customer contacts Harlone at contact@harlone-watch.com.

Commercial warranty. Harlone does not offer a commercial warranty in addition to the legal guarantees above.

Procedure. For any fault or defect, the customer contacts Harlone by email at contact@harlone-watch.com, stating their order number and their watch’s number; Harlone tells them how to proceed.

Article 10 — Liability and force majeure

Harlone cannot be held liable for failing to perform its obligations in the event of force majeure within the meaning of Article 1218 of the French Civil Code. In such a case, the customer is informed as soon as possible and retains the benefit of the refund commitment set out in Article 7.

Article 11 — Personal data

The data needed to process the order is handled in accordance with our privacy policy.

Article 12 — Complaints

For any complaint, the customer first contacts Harlone at contact@harlone-watch.com.

Article 13 — Governing law

These Terms are governed by French law. In the event of a dispute, and failing an amicable resolution, the French courts have jurisdiction under the conditions provided for by law.
